Student Code of Conduct and College Discipline System
Revised July, 2007

Conduct Violations

As members of the College community, students and their organizations have an obligation to know and obey the Student Code of Conduct. Through its policies and regulation statements, the College has made an effort to outline the behavioral expectations it holds. In general, the College expects that the common sense of a mature and responsible individual will determine if the behavior is one that should be avoided and can be addressed by the College Discipline System.

Accordingly, the following list is intended to serve as examples of behaviors that are considered unacceptable for students enrolled at Keene State College. College policies are described in detail in the Student Handbook. This list is intended, therefore, to be illustrative and not exhaustive.

SECTION 1 – GENERAL VIOLATIONS
Violation of the Statement of Student Rights and Responsibilities for Keene State College community.

Violation of any published policies, rules, and regulations of Keene State College, whether occurring on or off campus.

SECTION 2 – CAMPUS VIOLATIONS

  • 2.1   Failure to comply with the reasonable directions of a College official acting in the performance of his or her duties.
  • 2.2   Failure to comply with the reasonable directions of campus safety officers, law enforcement officers, or fire department personnel acting in the performance of their duties.
  • 2.3   Failure to provide complete and truthful information to a College official.
  • 2.4   Failure to carry or surrender one’s student ID to a College Official upon his or her request.
  • 2.5   Failure to obey federal, state, or local laws. College disciplinary proceedings may be instituted against a student who is subject to prosecution for violation of law in any judicial venue without regard to the pendency or outcome of the judicial proceedings, when the conduct alleged is also a violation of the Student Code of Conduct.
  • 2.6   Forgery, alteration, or misuse of any College document, record, or instrument of identification.

SECTION 3 – RESIDENTIAL VIOLATIONS

Guests
  • 3.1   Failure to be responsible for the conduct of a guest or visitor.
  • 3.2   Violation of the Residential Life Visitation Policies.
Noise
  • 3.3   Violation of courtesy hours.
  • 3.4   Violation of quiet hours.
  • 3.5   Violation of strict quiet hours.
Window
  • 3.6   Removal of window(s) and/or screen(s).
  • 3.7   Climbing on roofs and/or ledges.
  • 3.8   Ejecting, hanging, or attaching any object out a
  • window.
Miscellaneous
  • 3.9   Unauthorized pets and/or violation of the canine control policy.
  • 3.10   Unauthorized storage or preparation of food.
  • 3.11   Playing sports in undesignated areas.
  • 3.12   Defacing or vandalizing facilities.
  • 3.13   Smoking in undesignated areas.
  • 3.14   Unauthorized solicitations or sales within a residence hall or area.
  • 3.15   Unauthorized alterations or modifications to residence hall or area rooms.
  • 3.16   Improper storage or disposal of rubbish, garbage, or recyclable material.
  • 3.17   Unhealthful or unsanitary room condition.

SECTION 4 – ALCOHOL VIOLATIONS

  • 4.1   Criminal conviction or failure to contest charges for a violation of federal, state, or local law regarding alcohol.
  • 4.2   Underage possession of alcohol.
  • 4.3   Underage consumption of alcohol.
  • 4.4   Public consumption of alcohol.
  • 4.5   Purchasing or providing alcohol to a minor.
  • 4.6   Hosting an unauthorized function on campus where alcohol is served.
  • 4.7   Illegal distribution of alcohol.
  • 4.8   On campus possession of an unauthorized quantity of alcohol, including kegs or beer balls.
  • 4.9   Public intoxication.
  • 4.10   Abuse of alcohol.
  • 4.11   Possession and/or use of paraphernalia intended for the abuse of alcohol.
  • 4.12   Possession of equipment or paraphernalia associated with drinking games.
  • 4.13   Participation in any form of drinking games.
  • 4.14   Underage possession or display of alcohol containers.

SECTION 5 – CONTROLLED SUBSTANCE VIOLATIONS

  • 5.1 Use of a controlled substance except as expressly permitted by law.
  • 5.2 Possession of a controlled substance except as expressly permitted by law.
  • 5.3 Distribution of a controlled substance except as expressly permitted by law.
  • 5.4 Possession and/or use of controlled substance paraphernalia.

SECTION 6 – GAMBLING VIOLATIONS

  • 6.1   Engaging in illegal gambling.

SECTION 7 – KEY, COMBINATION, AND CARD ACCESS VIOLATIONS

  • 7.1   Unauthorized or inappropriate use or loan of keys, combinations, or access cards to any College owned or operated facility.
  • 7.2   Neglectful or intentional misuse or improper storage of any keys, combinations, or access cards to any College-owned or -operated facility.
  • 7.3   Tampering with or damaging any door or lock of a College-owned or -operated facility.
  • 7.4   Entry into any college property that is not normally accessible to an individual, including misuse of College issued keys, combinations, or access cards of actual forcible entry.
  • 7.5   Propping of any internal or external door of a College-owned or -operated facility.
  • 7.6   Three or more "lock outs" that require Residential Life staff assistance.

SECTION 8 – FIRE AND SAFETY VIOLATIONS

  • 8.1   Violation of fire safety policies. 8.2 Illegal or unauthorized possession of firearms, explosives (including fireworks), other weapons (i.e., hunting knives, bows and arrows, martial arts weapons, etc.), or dangerous chemicals on College Premises or at College-sponsored events.
  • 8.3   Use and/or possession of prohibited electrical appliances on College Premises or at College-sponsored events.
  • 8.4   Use and/or possession of burned or burning candles or incense except when authorized by a College Official on College Premises or at College-sponsored events.
  • 8.5   Unauthorized furnishings in residential facilities.
  • 8.6   Unauthorized room decorations in residential facilities.
  • 8.7   Tampering with fire prevention, fire safety, or fire fighting equipment.
  • 8.8   Causing an unnecessary emergency evacuation on College premises or at a College sponsored event.
  • 8.9   Failure to follow fire drill and/or other emergency procedures including evacuation.
  • 8.10   Accessing or using a fire escape except in emergency situations.

SECTION 9 – PERSONAL INJURY VIOLATIONS

  • 9.1   Conduct that is disruptive, lewd, indecent, or unreasonably infringes upon the rights of others (i.e., use of profanity, obscenity, public nudity, sexual activity in public places, water fights, etc.).
  • 9.2   Physical assault – physically beating another and/ or inflicting any menacing touch to another person.
  • 9.3   Verbal assault – a verbal attack that is a threat to someone’s physical safety.
  • 9.4   Specific conduct that threatens or endangers the health or safety of self or others.
  • 9.5   Threats – statements or action that causes an individual(s) to reasonably fear for his or her safety.
  • 9.6   Coercion – statements or action that is intended to improperly compel or force an individual to act in a manner that is contrary to their chosen style.
  • 9.7   Harassment – behavior(s) or statement(s) that have the purpose or effect of unreasonably interfering with an individual(s) academic, social, or work-related functions.
  • 9.8   Sexual harassment – detailed definition appears in an earlier section of this Student Handbook.
  • 9.9   Sexual contact that occurs without the consent of the victim, or when the victim is unable to give consent.
  • 9.10   Sexual assault – detailed definition appears in an earlier section of this Student Handbook.
  • 9.11   Assault of a College official – unwanted physical contact with an employee of the College.

SECTION 10 – THEFT AND DAMAGE VIOLATIONS

  • 10.1   Attempted or actual theft of College, individual, or group property.
  • 10.2   Unauthorized possession of College, individual, or group property.
  • 10.3   Attempted or actual damage to College, individual, or group property.

SECTION 11 – DINING COMMONS VIOLATIONS

  • 11.1 Violation of any published College policy in the Dining Commons.
  • 11.2 Violation of the conditions of the meal contract.
  • 11.3 Conduct that is disruptive to the normal operations of the Dining Commons.
  • 11.4 Unauthorized entrance to, or use of, the Dining Commons facility.

SECTION 12 – COLLEGE COMMUNITY VIOLATIONS

  • 12.1   Tampering with the election of any College recognized student organization.
  • 12.2   Disruption or obstruction of administration or activities of the College, including its public service functions on or off campus, or other authorized non-College activities when the act occurs on College Premises.
  • 12.3   Participation in a campus demonstration that disrupts the normal operations of the College or infringes on the rights of members of the College community.
  • 12.4   Leading or inciting to disrupt scheduled and/or normal activities within any College facility or area.
  • 12.5   Breach of the peace or aiding, abetting, or procuring another person to breach the peace on College
  • premises or at a College-sponsored events.
  • 12.6   Disruption of the free flow of pedestrian or vehicular traffic on College Premises or at Collegesponsored Events.
  • 12.7   Violation of the College or Residential Life posting policies.
  • 12.8   Unauthorized use of the College’s name, seal, or College-approved logo.
  • 12.9   Violation of the College’s fund-raising policies.
  • 12.10   Disruption or obstruction of academic teaching or research activities of the College either on or off campus.
  • 12.11   Violation of any College library policies.
  • 12.12   Violation of the scheduling of student activities policy.
  • 12.13   Disruptive behavior in the classroom – behavior which substantially or repeatedly interferes with the conduct of a class.

SECTION 13 – RECOGNIZED STUDENT ORGANIZATION VIOLATIONS

  • 13.1   Violation of the College’s Hazing Policy.
  • 13.2   Criminal conviction for a violation of New Hampshire state law prohibiting hazing (e.g., N.H. RSA §631-7).
  • 13.3   Violation of the standards regarding the relationship between a student organization and the advisor.
  • 13.4   Violation of any part of a student organization’s constitution or by-laws.
  • 13.5   Violation of any regulation or policy duly instituted by a student organization.
  • 13.6   Misuse of a student organization’s funds.
  • 13.7   Violation of any portion of the Statement of Relationship between Keene State College and Greek organizations.
  • 13.8   Violation of any portion of the Keene State College Panhellenic Constitution.
  • 13.9   Violation of any portion of the Constitution of the Interfraternal Council of Keene State College.

SECTION 14 – TECHNOLOGY AND TELECOMMUNICATIONS VIOLATIONS

  • 14.1   Unauthorized entry into a computer file.
  • 14.2   Unauthorized transfer of a computer file.
  • 14.3   Unauthorized use of a computer identification code or password.
  • 14.4   Use of computing facilities to interfere with the work of another student, faculty member, or College official.
  • 14.5   Use of computing facilities or telecommunications system to disseminate obscene, harassing, or abusive messages.
  • 14.6   Use of computing facilities to interfere with the normal operations of the College computing system.
  • 14.7   Unauthorized alteration of the College’s telecommunications voicemail system.
  • 14.8   Unauthorized alteration of the College’s telecommunications, computer, or cable television wiring or connections.
  • 14.9   Installing an unauthorized telephone on the College’s telecommunications system.
  • 14.10   Violation of any portion of the Computer and Network Use Policy.
  • 14.11   Attempted or actual theft or abuse of College computing resources.

SECTION 15 – DISCIPLINE SYSTEM VIOLATIONS

  • 15.1   Failure to appear as required before the Dispute Resolution Coordinator, the Hearing Officer, or a College Hearing Board.
  • 15.2   Falsification, distortion, or misrepresentation of information to the Dispute Resolution Coordinator, the Hearing Officer, or a College Hearing Board.
  • 15.3   Disruption or interference with the orderly conduct of a College Discipline System proceeding.
  • 15.4   Knowingly filing a complaint against a member of the College community without cause.
  • 15.5   Attempting to discourage an individual’s proper participation in or use of the College Discipline System.
  • 15.6   Attempting to influence the impartiality of a member of the College Discipline System prior to or during the course of a disciplinary proceeding.
  • 15.7   Harassment, intimidation or retaliation against a witness or a member of the College Discipline System prior to, during the course of, or after a disciplinary proceeding.
  • 15.8   Failure to comply with the sanction(s) imposed under the College Discipline System.
  • 15.9   Influencing or attempting to influence another person to commit an abuse of the College Discipline System.
