NH Supreme Court Ruling on Medical Malpractice Fund Surplus
To the Campus Community:
The Union Leader has reported that the New Hampshire Supreme Court has upheld a lower court decision that denied the state access to $110 million in medical malpractice funds. Gov. John Lynch had hoped to use funds from the Joint Underwriting Association reserves to balance the 2009 budget, and another $45 million in the 2010-2011 budget.
Last week the Legislature agreed to use $79 million from the state's rainy day fund to make up the deficit in the 2009 budget. However, this decision will impact negotiations on the 2010-2011 budget.
